ศึกษาความเหมาะสมการยกฐานะเทศบาลเมืองมาบตาพุดเป็นท้องถิ่นรูปแบบพิเศษ

Abstract

Development of the industrial sector in Thailand has various direct affect to the Map Ta Pud Municipality, the location of a large industrial estate. The Map Ta Pud Municipality is a local government administration responsible for management of local issues. However, as a local municipality, govern by the Municipal Act B.C. 2496 (and its revisions) and the Organization and Administration Act and Amendment Act B.C. 2542, it has many limitations for its operations in such a special circumstance. The issues range from management flexibility, resource and income limitations to various authority being responsible by other government agencies. The effect is that the Map Ta Pud Municipality cannot effectively and efficiently manage the local area. Hence, the government body has assigned the Thammasat University Research and Consultancy Institute to conduct a research on the appropriate form of governance for the Map Ta Pud area as a Special Form of Local Government. The objective for the study is as follows. 5) To study the potential and direction of development for the Map Ta Pud area 6) To study issues and limitations of current local administrative form of the Map Ta Pud Municipality 7) To study the appropriate form of government for the area as a Special Form of Local Government 8) To draft the Constitutional Act and Regulation for Map Ta Pud governance as a Special Form of Local Government

The research group conducts the study through literature review, indebt interview, focus groups, and questionnaires to aggregate data on the issues of the Map Ta Pud Municipality as well as the current status of Map Ta Pud management by the Municipality. The data is used to form a proposal to elevate the Map Ta Pud Municipality to the Special Form of Local Government. From the study, it is found that the Map Ta Pud Municipality faces many challenges from the industrial development, consisting of problems in environmental and natural resource, local residential quality of life, infrastructure and public amenities. The area also suffers from risks in chemical fallout, industrial hazards and conflicts between the industrial sector and local population. At the same time, the Map Ta Pud Municipality itself also has limitations in its internal operations, such as development and control of local industrial sector, promotion of environment and waste control, citizen quality of life, infrastructure and prevention and mitigation of public hazards. From the issues above, combined with the reality of the area at present, the research group proposes to elevate the governance to a Special Form of Local Government as an industrial ecosystem. Also to successfully drive the area forward, the region must possess strategic capacity to solve complex issues within the region. Important roles that must be played by the newly formed local government consists of the following. (1) Act as an independent central agency in public management (2) Act as a decision making and problem solving mechanism for issues within the area (3) Act as a coordinating body for other agencies The research group proposes a vision for the development of the Map Ta Pud towards a Map Ta Pud Special City, “Industrial City creating wealth by prioritizing its citizens and environment.” There are six strategies for the city’s development as follows. (7) Regulate, promote, and develop environmental friendly industrial activities that is safe for local population

(8) Elevate the capacity towards an pilot industrial city in pollution control (9) Develop basic infrastructure and local amenities that is balanced with the growth rate of the city (10) Develop the quality of life of its citizen towards a happy city (11) Move towards a safe city with high capacity for management of disasters and public hazards (12) Promote the economy of the city through development of income streams and vocational training towards a wealthy city At the same time, the research group also propose a managerial structure for the Special City of Map Ta Pud in three pillars, the executive branch from election by the local population similar to other local administration in Thailand, the legislative branch consisting of 24 representatives similar to Municipalities, and the Strategic Supervisory Committee for supervision and recommendation of the operational process according to the six strategies of the city. For the proposal relating to the income of the Map Ta Pud Special City, the group proposes for improvement of income through two points. One is through raising the income within the existing income structure such as changing the tax rate from the government and ratio of various subsidies. Second is through the local environment with the goal of regulating the usage of the surrounding natural resource. The tax on the environment is considered to be a new tax specifically for the management of the Map Ta Pud Special City. 0.0

การพัฒนาภาคอุตสาหกรรมของประเทศได้ส่งผลให้เมืองมาบตาพุดซึ่งเป็นที่ตั้งของอุตสาหกรรมขนาดใหญ่ได้รับผลกระทบในหลายด้าน เทศบาลเมืองมาบตาพุดในฐานะเป็นองค์กรปกครองส่วนท้องถิ่นรับผิดชอบ ในพื้นที่ได้พยายามจัดการกับปัญหา หากแต่เนื่องจากมีฐานะเป็นเทศบาล ซึ่งโครงสร้างและขอบเขตอำนาจหน้าที่ตามพระราชบัญญัติเทศบาล พ.ศ. 2496 (และรวมถึงฉบับแก้ไขเพิ่มเติม) รวมถึงพระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ. 2542 ยังมีข้อจำกัดหลายประการในการจัดการพื้นที่ที่มีลักษณะพิเศษเฉกเช่นพื้นที่มาบตาพุดทั้งในเรื่องความคล่องตัวในการบริหารงาน ข้อจำกัดด้านทรัพยากรและแหล่งรายได้ รวมทั้งข้อจำกัดในเรื่องอำนาจหน้าที่ ภารกิจหลายประการอยู่ในความรับผิดชอบของส่วนราชการอื่นๆ ซึ่งส่งผลให้เทศบาลเมืองมาบตาพุดไม่สามารถบริหารงานพื้นที่มาบตาพุดได้อย่างมีประสิทธิภาพประสิทธิผล เทศบาลเมืองมาบตาพุดจึงมอบหมายให้สถาบันวิจัยและให้คำปรึกษาแห่งมหาวิทยาลัยธรรมศาสตร์ (TU-RAC) ศึกษาวิจัยรูปแบบองค์กรปกครองส่วนท้องถิ่นที่เหมาะสมสำหรับเมืองมาบตาพุดในฐานะเป็นองค์กรปกครองส่วนท้องถิ่นรูปแบบพิเศษ โดยมีวัตถุประสงค์ในการศึกษาดังนี้ 1) เพื่อการศึกษาวิจัยศักยภาพและทิศทางการพัฒนาของพื้นที่เมืองมาบตาพุด 2) เพื่อการศึกษาปัญหาและข้อจำกัดของรูปแบบองค์กรปกครองส่วนท้องถิ่นปัจจุบันของเทศบาลเมืองมาบตาพุด 3) เพื่อการศึกษาวิจัยรูปแบบองค์กรปกครองส่วนท้องถิ่นที่เหมาะสมของเมืองมาบตาพุดในฐานะองค์กรปกครองส่วนท้องถิ่นรูปแบบพิเศษ 4) เพื่อยกร่างพระราชบัญญัติระเบียบบริหารเมืองมาบตาพุดในฐานะองค์กรปกครองส่วนท้องถิ่นรูปแบบพิเศษ คณะวิจัยได้ดำเนินการศึกษาโดยใช้วิธีการวิจัยเอกสาร การสัมภาษณ์เชิงลึกผู้ที่เกี่ยวข้อง การประชุมกลุ่มย่อย และการใช้แบบสอบถาม เพื่อให้ได้ข้อมูลเกี่ยวกับสภาพปัญหาของพื้นที่เมืองมาบตาพุด และสภาพปัญหาด้านการบริหารงานของเทศบาลเมืองมาบตาพุดในปัจจุบันอย่างรอบด้าน และนำข้อมูลเหล่านั้นมาสร้างข้อเสนอเพื่อยกฐานะเทศบาลเมืองมาบตาพุดเป็นองค์กรปกครองส่วนท้องถิ่นรูปแบบพิเศษ จากการศึกษาพบว่า เมืองมาบตาพุดได้รับผลกระทบจากภาคอุตสาหกรรมจนประสบปัญหาหลายประการ ได้แก่ ปัญหาด้านสิ่งแวดล้อมและทรัพยากรธรรมชาติ ปัญหาคุณภาพชีวิตประชาชน ปัญหาด้านสาธารณูปโภคและโครงสร้างพื้นฐาน ความเสี่ยงอุบัติภัยจากสารเคมีและวัตถุอันตราย ปัญหาความขัดแย้งระหว่างภาคอุตสาหกรรมและชุมชน/ประชาชน ขณะเดียวเทศบาลเมืองมาบตาพุดเองก็เผชิญปัญหาและข้อจำกัดในการดำเนินภารกิจที่สำคัญในหลายด้านเช่นกัน ได้แก่ ด้านการพัฒนาและควบคุมอุตสาหกรรมในพื้นที่ ด้านการส่งเสริมสิ่งแวดล้อมและควบคุมมลภาวะ ด้านคุณภาพชีวิตประชาชน ด้านสาธารณูปโภคและโครงสร้างพื้นฐาน และด้านการป้องกันและบรรเทาสาธารณภัย จากประเด็นปัญหาสำคัญที่คณะผู้วิจัยได้ค้นพบ ประกอบกับสภาพความเป็นจริงของเมืองมาบตาพุดในปัจจุบัน คณะผู้วิจัยจึงเสนอให้เมืองมาบตาพุดยกฐานะเป็นเมืองพิเศษด้านอุตสาหกรรมนิเวศ และเพื่อให้การจะขับเคลื่อนเทศบาลเมืองมาบตาพุดเป็นไปอย่างมีประสิทธิภาพ จำเป็นที่เมืองพิเศษจะต้องมีความสามารถและศักยภาพในการดำเนินยุทธศาสตร์เพื่อแก้ปัญหาที่เกี่ยวข้องในพื้นที่ซึ่งบทบาทสำคัญที่เมืองพิเศษมาบตาพุดจำเป็นต้องแสดงในฐานะผู้บริหารจัดการเมือง ได้แก่ (1) เป็นหน่วยกลางในการจัดบริการสาธารณะอย่างมีเอกภาพ (2) เป็นกลไกในการตัดสินใจ/แก้ไขปัญหาของพื้นที่ได้อย่างทันท่วงที (3) เป็นกลไกในการประสานงานกับหน่วยงานอื่น ๆ คณะผู้วิจัยเสนอวิสัยทัศน์ในการพัฒนาเมืองมาบพุดสู่การเป็นเมืองพิเศษมาบตาพุด คือ “เมืองอุตสาหกรรมที่สร้างความมั่งคั่งโดยให้ความสำคัญกับการดูแลประชาชนและคุณภาพสิ่งแวดล้อม” โดยมียุทธศาสตร์ในการพัฒนาเมืองทั้งสิ้น 6 ด้าน ได้แก่ (1) การควบคุม ส่งเสริม และพัฒนาอุตสาหกรรมในพื้นที่ให้เป็นมิตรต่อสิ่งแวดล้อมและปลอดภัยต่อการดำรงชีวิตของประชาชน (2) การยกระดับศักยภาพในการเป็นเมืองอุตสาหกรรมต้นแบบในการควบคุมมลภาวะ (3) การพัฒนาโครงสร้างพื้นฐานและระบบสาธารณูปโภคสาธารณูปการที่สมดุลกับการเจริญเติบโตของเมือง (4) การพัฒนาคุณภาพชีวิตประชาชน เพื่อก้าวไปสู่การเป็นเมืองแห่งความสุข (5) การก้าวไปสู่การเป็นเมืองที่ปลอดภัยและมีศักยภาพสูงในการจัดการความเสี่ยงด้านอุบัติภัยและสาธารณภัย (6) การส่งเสริมเศรษฐกิจของเมือง การพัฒนาแหล่งรายได้และการส่งเสริมการประกอบอาชีพของประชาชน เพื่อก้าวไปสู่การเป็นเมืองแห่งความมั่งคั่ง พร้อมกันนี้คณะผู้วิจัยได้เสนอให้จัดโครงสร้างการบริหารงานภายในเมืองพิเศษมาบตาพุดเป็น 3 ฝ่ายที่สำคัญ ได้แก่ (1) ฝ่ายบริหาร ซึ่งมาจากการเลือกตั้งของประชาชนเช่นเดียวกับองค์กรปกครองส่วนท้องถิ่นอื่น ๆ ในประเทศไทย (2) ฝ่ายสภา มีจำนวน 24 คน เช่นเดียวกับเทศบาลนคร และ (3) คณะกรรมการกำกับและขับเคลื่อนยุทธศาสตร์เมือง ทำหน้าที่กำกับดูแลและให้ข้อเสนอแนะการดำเนินภารกิจพิเศษ ตามยุทธศาสตร์ 6 ด้านของเมืองพิเศษมาบตาพุด สำหรับข้อเสนอเกี่ยวกับแนวทางการจัดเก็บรายได้ของเมืองพิเศษมาบตาพุดนั้น คณะผู้วิจัยเสนอว่าแหล่งรายได้ที่ควรมีการพัฒนาปรับปรุงสามารถจำแนกได้เป็น 2 ส่วนสำคัญ คือ 1) การพัฒนารายได้เพิ่มเติมบนโครงสร้างรายได้เดิมที่มีอยู่ในปัจจุบัน อาทิ การเปลี่ยนแปลงสัดส่วนรายได้ภาษีจัดสรรจากรัฐบาล การปรับปรุงเกณฑ์การจัดสรรเงินอุดหนุน เป็นต้น และ 2) การพัฒนารายได้บนฐานสิ่งแวดล้อมซึ่งการจัดเก็บรายได้จากสิ่งแวดล้อมมีเป้าหมายหลักเพื่อใช้ในการกำกับดูแลสิ่งแวดล้อมเป็นสำคัญซึ่งภาษีบนฐานสิ่งแวดล้อมนั้นนับได้ว่าเป็นภาษีใหม่ที่กำหนดขึ้นเพื่อบริหารจัดการเมืองพิเศษมาบตาพุดโดยเฉพาะ
