จัดหมวดหมู่อาชญากรรมในกฎหมายไทยเข้ากับหมวดหมู่ ตามมาตรฐานระหว่างประเทศว่าด้วยการจำแนกประเภทอาชญากรรม เพื่อประโยชน์ทางสถิติ ระยะที่ 1

Abstract

โครงการนี้มีวัตถุประสงค์สองประการ คือ ประการแรก จัดหมวดหมู่อาชญากรรมในประมวลกฎหมายอาญาและพระราชบัญญัติที่มีโทษทางอาญาของไทย ให้เข้ากับหมวดหมู่ ๐๑ ความผิดเกี่ยวกับชีวิต และหมวดหมู่ ๐๓ ความผิดเกี่ยวกับเพศ ของตามมาตรฐานระหว่างประเทศว่าด้วยการจำแนกประเภทอาชญากรรมเพื่อประโยชน์ทางสถิติ( ICCS version 1.0) ประการที่สอง หาแนวทางที่มีประสิทธิภาพและแนวทางการแก้ไขปัญหาหากมี ในการจัดทำหมวดอื่นที่เหลือของมาตรฐานระหว่างประเทศ วิธีการศึกษา (๑) ศึกษาวิจัยเอกสาร ตำรา และแนววินิจฉัยของศาลฎีกา และข้อมูลกฎหมายทางเวปไซด์ ที่เกี่ยวกับการจัดหมวดหมู่อาชญากรรมตามมาตรฐานระหว่างประเทศว่าด้วยการจำแนกประเภทอาชญากรรม และความหมายและองค์ประกอบของความผิดในประเทศไทยและต่างประเทศ (๒) จัดความผิดในกฎหมายไทยตามแนวทางของการจัดหมวดหมู่ตามมาตรฐานสากล และรับฟังความเห็นของผู้เชี่ยวชาญสองครั้ง แล้วมาสรุปและจัดทำรายงานสมบูรณ์พร้อมด้วยคำอธิบายในการจัดทำหมวดหมู่อาชญากรรม รวมถึงข้อสังเกตต่างๆ ผลการศึกษา 1. การจัดหมวดหมู่อาชญากรรมในหมวด ๐๑ ได้นำมาจัดระบบตามความหมายที่มาตรฐานระหว่างประเทศกำหนดเกือบทั้งหมด แต่มีบางฐานความผิดเช่น ความผิดฐานฆ่าคนตาย และ extrajudicial killing ที่ยังมีความหมายไม่ตรงกับความผิดในกฎหมายไทย และไม่มีนิยามในกฎหมายไทยแล้วแต่กรณี 2. การจัดหมวดหมู่ ในหมวด ๐๓ ได้จัดหมวดหมู่เข้ากับมาตรฐานสากล แต่มีบางฐานความผิดที่มีความคาบเกี่ยวกับ หมวด ๐๒ และหมวด ๐๘ ได้จัดไว้ในหมวด ๐๒ และ ๐๘ จึงไม่ปรากฏในหมวด ๐๓ ตามตารางที่จัดกลุ่ม นอกจากนี้ ในความผิดที่กระทำในสถานที่หรือยานพาหนะเป็นพิเศษ ได้ไปจัดรวมไว้ในหมวด ๐๓๐๑ แทนที่จะแยกรายละเอียดลงไปในแต่ละหมวดย่อย เพื่อสะดวกในการจัดลงของผู้ปฏิบัติต่อไป และสอดคล้องกับแนวทางของมาตรฐานสากล 3. ข้อสังเกตจากการจัดทำในหมวด ๐๑ และ ๐๓ หากลงไปในรายละเอียดตามมาตรฐานที่กำหนดแล้ว จะมีความยุ่งยากต่อผู้ปฏิบัติและในการลงข้อมูลของหน่วยงานในประเทศไทยปัจจุบันไม่ได้แยกแยะไว้ละเอียดเช่นนั้น ดังนั้น ในการจัดหมวดหมู่ทางวิชาการจะจัดแยกแยะให้ละเอียดที่สุดแต่ในทางปฏิบัติที่จะนำไปใช้จริงอาจต้องปรับให้มีลงรายละเอียดเพียงเท่าที่จะสามารถสรุปได้จากข้อมูลในรายงานคดี และในบางฐานความผิดที่ไม่ชัดเจนคงต้องสอบถามทางผู้จัดทำมาตรฐานต่อไป This Research project has two aims: firstly, to classification Thai criminal offences in Penal Code and others Acts harmonized to section 01, acts leading to death or intending to cause death, and section 03, Injurious acts of a sexual nature of The International Classification of Crime for Statistical Purposes (ICCS) version 1.0 and secondly, to explore an efficacy guidelines and the way to solve any problems in classification on left of others section of ICCS. Methodology: the research has done in terms of qualitative research by (1) reviewing documentary : textbooks, Thai supreme court decisions and legal information in website relating to the classification of offences under The International Classification of Crime for Statistical Purposes (ICCS) version 1.0. In addition, explores meaning and element of crimes in Thai and Foreign Penal Laws. (2) to classify offences in Thai penal laws which relate to sections 01 and 03 of ICCS and presenting to two experts seminars and get their comments and recommends to improve the final report of this research. Research outcomes: 1. Almost of offences in Thai Penal Code and others Act related to section 01 of the Classification of section 01 ICCS have been fit in except a few offenses eg, murder and extrajudicial killing due to definition of offence is not match and no definition in Thai penal law in some offences. 2. As for classification of section 03 ICCS, some offences have been related to the others section such as 02 and 08 of ICCS therefore, researchers put some of offences in those section not put in this section. In addition, sexual offences which have been committed in special places or vehicles have been classified in sub section 0301 instead of to be put in the other subsection because of it should be easy for the official to proceed the data collection in practical and harmonized to the international standard. 3. For explanatory note in section 01 and 03 if we classify any offences according to the implementation of ICCS which so much in detail, it would make so difficult for the authority who responsible for collecting crime statistics in Thailand because Thailand does not set up yet the template and systematic collection crime statistics. However, our team provided classification of crime as academics in detail as ICCS recommend but for classifying in practice should be classify in detail which can be find in particle. Moreover, in some offences should be consulted with the UN expert for implementation in the future.
