ศึกษาแนวทางการยกร่างกฎหมายขจัดการเลือกปฏิบัติต่อบุคคล

Abstract

โครงการวิจัยนี้มีวัตถุประสงค์ สามประการ คือ ประการแรก เพื่อศึกษา วิเคราะห์ กฎหมายไทยและต่างประเทศที่เกี่ยวกับการขจัดการเลือกปฏิบัติต่อบุคคลเพื่อนำมาจัดทำแนวทาง มาตรการส่งเสริม ป้องกันการเลือกปฏิบัติต่อบุคคล และเยียวยาผู้ที่ได้รับผลกระทบจากการเลือกปฏิบัติต่อบุคคลประการที่สอง เพื่อรับฟังความคิดเห็นหน่วยงานที่เกี่ยวข้อง ภาคเอกชน และประชาชน เพื่อประกอบการจัดทำร่างกฎหมาย รวมทั้งการวิเคราะห์ผลกระทบที่อาจเกิดจากกฎหมายตามบทบัญญัติมาตรา 77 ของรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช ๒๕๖๐ และพระราชบัญญัติหลักเกณฑ์การจัดทำร่างกฎหมายและการประเมินผลสัมฤทธิ์ของกฎหมาย พ.ศ. ๒๕๖๒ และประการสุดท้าย ยกร่างกฎหมายขจัดการเลือกปฏิบัติต่อบุคคล และกรอบการร่างอนุบัญญัติ ให้สอดคล้องกับมาตรฐานสากล และเหมาะสมกับบริบทของประเทศไทยอย่างเป็นระบบครบถ้วนสมบูรณ์ วิธีการศึกษา ศึกษาวิจัยเอกสาร ของไทยและต่างประเทศ ได้แก่ สหราชอาณาจักร และแคนาดา รับฟังความเห็นผู้ที่เกี่ยวข้อง โดยนำเสนอร่างกฎหมาย และจัดทำแบบสอบถามเพื่อปรับปรุงกฎหมายตามแนวทางการจัดทำร่างพระราชบัญญัติชจัดการเลือกปฏิบัติต่อบุคคล พร้อมกรอบอนุบัญญัติ และรับฟังความเห็นจำนวน ๔ ภาคทางออนไลน์ และปรับปรุงร่างกฎหมายเพื่อรับฟ้งระดับชาติอีกครั้ง และนำผลการรับฟังมาปรับปรุงร่างพระราชบัญญัติ่พร้อมจัดทำรายงานผลกระทบต่อกฎหมาย และนำเสนอรายงานการศึกษาต่อกรมคุ้มครองสิทธิและเสรีภาพ กระทรวงยุติธรรม โดยมีระยะเวลาดำเนินการระหว่างวันที่ ๑๑ กุมภาพันธ์–๙ สิงหาคม ๒๕๖๔ ผลการศึกษา ได้รายงานผลการศึกษาซี่งประกอบด้วย การศึกษากฎหมายต่างประเทศ เกี่ยวกับกฎหมายและแนวทางการดำเนินการขจัดการเลือกปฏิบัติ และร่างกฎหมายขจัดการเลือกปฏิบัติต่อบุคคลที่เหมาะสมสำหรับประเทศ ไทย พร้อมด้วยกรอบกฎหมายลำดับรอง หลักการและเหตุผล สาระสำคัญของร่างพระราชบัญญัติและรายงานประเมินผลกระทบในการออกกฎหมายตามหลักเกณฑ์ที่รัฐธรรมนูญและพระราชบัญญัติหลักเกณฑ์การจัดทำร่างกฎหมายและการประเมินผลสัมฤทธิ์ของกฎหมาย พ.ศ. ๒๕๖๒ โดยมีกลไก แนวทาง มาตรการ และกฎหมายคุ้มครองบุคคลทุกกลุ่มจากการถูกเลือกปฏิบัติต่อบุคคล ซึ่งเป็นกฎหมายที่ทัดเทียมกับระดับสากล This research study has three aims: firstly, to study and analyze Thai, English and Canada jurisdictions on Anti- discrimination legislation in order to develop Thai legislation and promotion, prevention measures on non-discrimination and compensate to whom has been discriminated. Secondly, to work on a process of regulatory impact assessment under section 77 of 2018 Thai Constitution and law on drafting and regulatory impact Assessment and Evaluation Act of B.E.2562 and thirdly, to draft on Anti-discrimination Act and regulations which should be harmonized and equal to international standards and fit in Thai custom and perfect systematic. Methodology of the research based on qualitative approach: reviewing documentary in both Thai and foreign countries such as England, Canada etc.; presenting and public hearing on a draft Anti-discrimination Act and regulations with questionnaires plus to the participations on four webinar meetings with consists of representative from both public and private sectors, experts and non-government organizations who are partnership and working on anti-discrimination activities. After modifying the draft Anti-discrimination Act and regulations, the national webinar meeting has been setting and present to the public in order to collect all recommends to modify the final Draft and submit to Department of Rights and Liberty Protection, Ministry of Justice. This all process of research have been done during 11 February to 9 August 2021. Research outcome: The Final report on draft Anti-discrimination Act and regulations consists of the comparative studies on Thai and Foreign jurisdictions in terms of prevention, promotion, legal and others measures for non-discrimination in person and compensation to whom has been discriminated. Most important, proposal of the Final Draft on Anti-discrimination Act and regulations including the explanatory memorandum, essence of the draft Act, report on regulatory Impact assessment under instructions of Thai Constitutional law and law on Drafting and Regulatory Impact Assessment and recommendation on guidelines , measures and legal protection for all group of person to free from discrimination which equal to international standards.
