Abstract

งานแปลฉบับนี้ เป็นการแปลพระราชบัญญัติการประกอบกิจการพลังงาน พ.ศ. 2550 ซึ่งเป็นกฎหมายที่ตราขึ้นเพื่อรองรับนโยบายการปรับโครงสร้างการบริหารกิจการพลังงานของประเทศ รวมถึงกฎหมายลำดับรองตามอำนาจหน้าที่แห่งพระราชบัญญัติการประกอบกิจการพลังงาน พ.ศ. ๒๕๕๐ ตั้งแต่ปี ๒๕๕๑ จนถึงปัจจุบัน ซึ่งตามพระราชกฤษฎีกาการทบทวนความเหมาะสมของกฎหมาย พ.ศ. ๒๕๕๘ มีผลใช้บังคับตั้งแต่วันที่ ๙ กันยายน ๒๕๕๘ โดยแยกงานนโยบายงานกำกับดูแล และการประกอบกิจการพลังงานออกจากกัน เปิดโอกาสให้ภาคเอกชน ชุมชน และประชาชนมีส่วนร่วมและมีบทบาทมากขึ้น รวมทั้งให้การประกอบกิจการพลังงานเป็นไปอย่างมีประสิทธิภาพ มีความมั่นคง มีปริมาณเพียงพอและทั่วถึง ในราคาที่เป็นธรรมและมีคุณภาพได้มาตรฐานตอบสนองต่อความต้องการและการพัฒนาประเทศอย่างยั่งยืนในด้านสังคมเศรษฐกิจ และสิ่งแวดล้อมคณะกรรมการกำกับกิจการพลังงาน (กกพ.) ได้รับการแต่งตั้งขึ้นตามบทบัญญัติแห่งพระราชบัญญัติการประกอบกิจการพลังงาน พ.ศ. 2550 เพื่อทำหน้าที่กำกับดูแลการประกอบกิจการไฟฟ้าและกิจการก๊าซธรรมชาติภายใต้กรอบนโยบายของรัฐ โดยมีสำนักงานคณะกรรมการกำกับกิจการพลังงาน (สำนักงาน กกพ.) ทำหน้าที่เป็นสำนักงานเลขานุการของ กกพ. ทั้งนี้ กกพ. ได้รับการโปรดเกล้าฯ แต่งตั้งเข้าดำรงตำแหน่งเมื่อวันที่ 1 กุมภาพันธ์ 2550 เป็นต้นมา ภารกิจหน้าที่ของ กกพ. ได้แก่ การออกใบอนุญาตประกอบกิจการพลังงาน การกำกับดูแลมาตรฐานทางวิศวกรรมและความปลอดภัยในการประกอบกิจการพลังงาน การกำกับดูแลอัตราค่าบริการ การให้ความเห็นต่อแผนพัฒนากำลังผลิตไฟฟ้า แผนการลงทุนในกิจการไฟฟ้า แผนการจัดหาก๊าซธรรมชาติและแผนการขยายระบบโครงข่ายพลังงาน การคุ้มครองผู้ใช้พลังงาน รวมถึงการออกกฎหมายลำดับรองเพื่อการกำกับดูแลการประกอบกิจการพลังงานเป็นไปตามให้เป็นไปตามบทบัญญัติแห่งพระราชบัญญัติการประกอบกิจการพลังงาน พ.ศ. 2550 กกพ. จึงได้จัดทำหนังสือรวมกฎหมายกิจการพลังงานนี้ ซึ่งเป็นหนังสือที่รวบรวมบรรดาระเบียบ ข้อบังคับ ประกาศ หรือข้อกำหนดต่าง ๆ ของ กกพ. เพื่อความสะดวกในการค้นหาและใช้ประโยชน์ในการดำเนินงานเผยแพร่ให้แก่บุคคล กลุ่มบุคคล ผู้ใช้พลังงาน ผู้รับใบอนุญาตประกอบกิจการพลังงาน ตลอดจนผู้ปฏิบัติงานที่เกี่ยวข้องให้ทราบ เข้าใจ และสามารถปฏิบัติตามกฎหมายได้อย่างชัดเจนและถูกต้อง This work is to translate The Energy Industry Act B.E. 2550, a Law issued in response to the government policy on National Energy Industry Management Restructuring, into English. Policy making, regulation, and operating functions of Energy Industry are hereby distinctly separated from one another, in order to enhance participation of the private sector, communities, and the general public so that Energy Industry Operation will be efficient, secure, adequate, and extensive, with reasonable prices and quality according to standards. Furthermore, this Act is a response to the domestic demand and sustainable development of the country, in terms of socio-economic and environmental aspects. Energy Regulatory Commission has been established, by virtue of the Energy Industry Act B.E. 2550, to regulate the Energy and Gas Industry Operation in compliance with government policy. In order for the Commission to execute their authority and duties, an Office of the Energy Regulatory Commission. The Commission got His Majesty the King’s gracious appointment on the 1st of February 2008. The Commission shall be responsible for the granting of Licenses in Energy Industry Operation; regulating technical standards and safety in Energy Industry Operation; regulating service fees; giving opinions on the Power Development Plan, Energy Industry Investment Plan, Natural Gas Acquisition Plan, and Energy Network System Expansion Plan; and protecting power consumers as well as issuing subordinate legislation to regulate Energy Industry in compliance with provisions of the Energy Industry Act B.E. 2550. In this regard, the Commission has prepared these commentaries of laws related to Energy Industry covering all regulations, proclamations, or other stipulations of the Commission for disseminating to interested persons, groups of persons, power consumers, Licensees of Energy Industry as well as relevant Operators for their acknowledgement, understanding and distinct abidance to the law.
